We hold the right to change or amend these Terms from time to time, and it is your responsibility to check them from time to time. Use of our website after such changes indicates your acceptance of these changes.

1. Order Acceptance and Cancellation 

When placing your order with SIVA, you are making an offer to purchase our products, but we must accept this offer before proceeding. You will note that we have the right to accept and/or decline your order for any reason including, but not limited to, lack of inventory, pricing and product description errors, suspected fraudulent activity, or payment authorization issues. 

Accordingly, in these scenarios, we may fully or partially cancel your order after notifying you. In the scenarios where an order is canceled after payment is made, we will issue a full refund through the original method of payment. 

Finally, confirmation emails received do not confirm our acceptance of the order but serve as notification that the order request was received.

2. Product Details and Information

SIVA makes every effort to provide full product descriptions, accompanying prices, and stock levels of products in a thorough and precise manner. That said, we do not promise that all information provided on this site is completely correct, current, or comprehensive. 

If you choose to rely on material, you do so at your own peril. We maintain the right to rectify any errors, provide clarifications, or update information as needed without prior notice. This extends to change or correct any product descriptions, pricing changes, availability updates, and shipping provided. 

We also reserve the right to refuse or cancel an order confirmed to be placed at an erroneous price or based on incorrect details, issued with inaccurate information, even if such an order has already been accepted and payment completed.

3. Pricing and Payment Terms

During checkout, the website's price for each item is listed in Dollars. Prices can spontaneously shift at any time prior to notice. The total amount payable encompasses the base product cost, tax, and shipping, all of which will be shown during checkout.

SIVA supports multiple payment options such as credit/ debit cards, net banking. Orders will only be dispatched once all payments have been completed. In the case of a pricing error, we reserve the right to cancel or refuse any orders that have been made at the erroneous price.

If an order cannot be processed due to lack of funds or no authorization, that order will not be acknowledged and an appropriate notification will be sent.

4. Shipping, Delivery, and Risk of Loss  

Our goal is to confirm the order and ship it immediately after receiving payment. The provided shipping timelines are only estimates at best. Although we attempt to meet the delivery schedule, delivery timelines may be affected by factors outside our control, such as postponements from the carrier, severe weather conditions, or logistical matters. 

You assume title and risk of loss for the products when they leave our facility. You assume full responsibility for all provided shipping details, whether or not they are correct. Any provided details that are incorrect may lead to delays or further fees. 

There are also additional charges if a package is returned to us due to an incorrect address or any other reason. We will no longer be held accountable for lost or stolen packages that have been confirmed delivered.

5. Returns, Refunds, and Exchanges

At SIVA, your satisfaction is important to us. If your order arrives damaged, defective, or contains an incorrect item, you may be eligible for a return, refund, or exchange within 7 calendar days of delivery.

All returned items must be unused, in original packaging, and in sellable condition.

Refunds will be issued to the original payment method once the returned item is received and verified. Please note:

All returns are processed in accordance with our fulfillment partner, Amazon Multi-Channel Fulfillment (MCF), and are subject to verification and approval.

6. Intellectual Property Rights 

The SIVA website contains texts, photographs, graphics, logos, images, product descriptions, and software that are owned by SIVA or its licensors. All of them are protected under law by copyright, trademark, and other forms of intellectual property law. 

You are not permitted to, without prior written authorization from us: reproduce, duplicate, copy, sell, resell, or exploit any part of the website or its contents. Legal action may be taken due to unauthorized use. For the avoidance of doubt, in this document, “you” refers to an individual who is a natural person of the age 18 or above. 

A non-exclusive, limited and revocable license is granted to access the website for individual use, non-business purposes only. Any access, misuse, or infringement of SIVA’s intellectual property would result in the termination of access granted, revocation of responsibility free access, and other legal actions.

By accessing our website, you undertake not to violate these Terms or any Laws relevant to you. Examples include, but are not limited to, the following: the sending of malicious code, the illegal use of our site, impersonation, and tampering with the website’s security features. 

You must not misuse our services by introducing or attempting to introduce viruses, trojans, or other comparable things as defined in law. Breach of these responsibilities may lead to termination of access and taking legal action, or reporting to the appropriate bodies. We preserve the right to monitor, investigate, and undertake legal action against violations of these Terms by any user.

8. Restriction of Liability

In accordance with applicable laws, SIVA will not be liable for any indirect, incidental, punitive, or consequential damage that may arise from using the website or purchasing products. This includes the inability to use the website or purchase products, and any loss of profits, data, goodwill artifacts or other losses of value. 

Our total liability under contract breach, warranty, tort (including negligence), or other grounds shall not exceed the total amount that was paid for the product in question. Due to varying laws in different places, some do allow the exclusion or limitation of certain damages, so these conditions might not apply in full to you.However, we attempt to remain within the bounds of applicable consumer protection laws.
